I experienced a life-altering event when I was 22, which resulted in the loss of my arm. Unlike many individuals who enter medicine, it was not something I contemplated from the beginning. I wanted to be a scientist...until I became disillusioned with that enterprise. Presumption of Guilt analyses the genesis and aftermath of the notorious kids for cash scandal. Mark A. Ciavarella, Jr. was an unethical juvenile court county judge who was willing to plead guilty to federal crimes as a result of his failure to properly account for millions of dollars he and his colleague received. However, he vehemently denied government allegations that he accepted that money as a quid pro quo for jailing juvenile delinquents.
Nonetheless, media dubbed Ciavarella the kids for cash judge and relentlessly covered the ensuing scandal. Pennsylvania officials presumed his guilt and enacted a commission to investigate how to remove the scandal's taint from the Commonwealth's juvenile court system. Crimes committed by juvenile delinquents during the period the scandal supposedly occurred were summarily erased, regardless of the severity of those crimes, leaving thousands of innocent victims devoid of justice.
Yet, prosecutors never proved the scandal ever happened. Although the lead prosecutor continued to give it lip service, no evidence was provided. Instead, prosecutors quietly removed the very allegations that had spawned kids for cash from the Superseding Indictment at the end of Ciavarella's trial. Ignoring the utter lack of proof of the scandal's existence, media falsely reported that Ciavarella was convicted for his participation in a scheme to jail juveniles for profit.
Afterwards prosecutors continued to insist that the scandal was real, referring to those redacted allegations as if they were proven facts. The United States Court of Appeals for the Third Circuit adopted those same unproven, redacted allegations as part of its precedential opinion on the matter.
This book demonstrates that fake news is real and the Presumption of Innocence is in jeopardy, especially when heinous allegations are presented. It is a reminder to make the government prove its case before accepting what it alleges. That is something neither the media nor public officials did for Ciavarella.
College is one of the most exciting and growth filled times in your life. It's a blustery December day in Springfield Massachusetts. The year - 1891. James Naismith, age 29 is a rare combination of violent rugby player and Presbyterian minister. He has his dream job as an athletic coach at the Y.M.C.A. but his boss threatens to fire him if he doesn't come up with a game to be played between the football and baseball seasons. Phog Allen protege, Gene Johnson, discovers Joe and hires him to play for the Globe Refiners with the goal of going to the Hitler Olympics in 1936. In preparation, at a Madison Square Garden game in 1936, the world sees the fast break, the zone press and for the first time Joe Fortenberry unveils his own invention - the Slam Dunk The Refiners join with the Hollywood Universals and they become the first U.S.A. Olympic basketball team.
After much controversy and many obstacles, they arrive in Berlin to win. However, the rules are changed, the ball is a balloon beach ball and the game is going to be played outdoors in rainy weather Their uniforms are stolen and other countries want to eliminate all players over 6'2. Still America perseveres. In the thrilling last game, it's pouring rain and even though the court is a mudpit, America wins 19-8 with Joe as the high scorer. The next day is sunny and beautiful for the awards ceremony. Naismith presents the first Olympic Gold Medal for Basketball to the U.S.A. team. The happiest day of my life. Indeed, James Naismith made the world a little better than he found it.
